Evidence that suits a request from Austria
For a request from Austria the useful evidence is a mark on the Austrian Patent Office or EU register, a name right under section 43 of the Civil Code, or proof that a profile is posing as you. The preparation checklist lists the rest: the exact handle, the profile it is for, and what ties the name to you.

Starting with Instagram in Austria
In Austria a registered mark from the Austrian Patent Office or an EU trade mark is the clearest proof for Instagram’s intellectual property form. Section 43 of the Civil Code (ABGB) also protects a person’s name against unauthorised use, which can support an impersonation report when a profile uses it. It is evidence for the platform to read, not a transfer order.
The four official routes are set out in the routes guide and compared on the routes comparison.
Facts to cite
- Trade marks: the Austrian Patent Office.
- Personal data: the GDPR and the Datenschutzgesetz, with the Austrian Data Protection Authority as the regulator.
- Consumer and advertising matters: the consumer protection bodies and KommAustria.
- Languages: German.
- Currency for the price: euro (EUR). The price is agreed in your chat or email before work starts.
These are reference points, not legal advice. A platform’s decision on a handle follows its own policy.
The other two platforms in Austria
An Austrian business account normally needs the information that the E-Commerce Act asks for, such as who operates it and how to reach them. That does not affect a claim, but it is a quick check on the profile that will receive the handle. For TikTok and Snapchat the trademark and infringement forms are the ones that apply.
Handle limits for both are on the TikTok rules and Snapchat rules pages.
The order of work
- You send the handle you want and the profile it is for, on WhatsApp or email, and say you are in Austria.
- We look at whether an official route fits the facts and tell you if it looks workable.
- The price is agreed in chat before any work starts.
- The request is filed with each platform’s process. The platform makes the final decision, and a claim that fails is covered by the refund policy.
