Evidence that suits a request from Canada
For a request from Canada the useful evidence is a mark on the CIPO register, a corporate or business-name record that matches the name, or proof that a profile is posing as you. The preparation checklist lists the rest: the exact handle, the profile it is for, and what ties the name to you.
Never send a password or a login code. Nobody who needs one is working through an official route. See claim scams.
Starting with Instagram in Canada
Canadian applicants have an easier path to a registered mark than they once did: since June 2019 CIPO no longer asks for a declaration of use before registration. A registered mark gives Instagram’s intellectual property form something concrete to read. Provincial business-name or incorporation records help show the name is yours, but they are not trade mark rights, so they support a claim rather than carry it.
The four official routes are set out in the routes guide and compared on the routes comparison.
Facts to cite
- Trade marks: the Canadian Intellectual Property Office (CIPO).
- Personal data: PIPEDA, with the Office of the Privacy Commissioner of Canada as the regulator.
- Consumer and advertising matters: the Competition Bureau.
- Languages: English and French.
- Currency for the price: Canadian dollar (CAD). The price is agreed in your chat or email before work starts.
These are reference points, not legal advice. A platform’s decision on a handle follows its own policy.
The other two platforms in Canada
French-language brands in Quebec often have accented names. TikTok and Snapchat usernames follow plain-letter rules, so the claim is for the unaccented spelling, and the filing should say so. Evidence that links the plain spelling to the accented name, such as the registered mark itself, keeps the request easy to read.
Handle limits for both are on the TikTok rules and Snapchat rules pages.
The order of work
- You send the handle you want and the profile it is for, on WhatsApp or email, and say you are in Canada.
- We look at whether an official route fits the facts and tell you if it looks workable.
- The price is agreed in chat before any work starts.
- The request is filed with each platform’s process. The platform makes the final decision, and a claim that fails is covered by the refund policy.
