Evidence that suits a request from Belgium
For a request from Belgium the useful evidence is a Benelux or EU trade mark, an enterprise record that matches the name, or proof that a profile is posing as you. The preparation checklist lists the rest: the exact handle, the profile it is for, and what ties the name to you.
Never send a password or a login code. Nobody who needs one is working through an official route. See claim scams.
Starting with Instagram in Belgium
Belgium has no national trade mark register of its own. BOIP in The Hague issues Benelux marks that also cover the Netherlands and Luxembourg, and an EU trade mark is the other option. Either is a registered right for Instagram’s intellectual property form. An entry in the Crossroads Bank for Enterprises shows a business exists, but it is not a trade mark.
The four official routes are set out in the routes guide and compared on the routes comparison.
Facts to cite
- Trade marks: the Benelux Office for Intellectual Property (BOIP).
- Personal data: the GDPR and the Belgian Data Protection Act, with the Belgian Data Protection Authority as the regulator.
- Consumer and advertising matters: the Federal Public Service Economy.
- Languages: Dutch, French and German.
- Currency for the price: euro (EUR). The price is agreed in your chat or email before work starts.
These are reference points, not legal advice. A platform’s decision on a handle follows its own policy.
The other two platforms in Belgium
Belgian brands often work in two or three languages, so the same brand may need handle variants that the platforms treat as different names. A claim should state which spelling is the brand’s main one. TikTok and Snapchat claims rest on the trademark and infringement forms.
Handle limits for both are on the TikTok rules and Snapchat rules pages.
The order of work
- You send the handle you want and the profile it is for, on WhatsApp or email, and say you are in Belgium.
- We look at whether an official route fits the facts and tell you if it looks workable.
- The price is agreed in chat before any work starts.
- The request is filed with each platform’s process. The platform makes the final decision, and a claim that fails is covered by the refund policy.
