Evidence that suits a request from Spain
For a request from Spain the useful evidence is a mark on the OEPM or EU register, a right to your name and image under Organic Law 1/1982, or evidence that a profile is posing as you. The preparation checklist lists the rest: the exact handle, the profile it is for, and what ties the name to you.

Starting with Instagram in Spain
A mark registered with the OEPM or at EU level is the clearest proof for Instagram’s intellectual property form. Spain also has Organic Law 1/1982 on the right to honour, privacy and one’s own image, which protects a person against the unauthorised use of their name or image. That is a legal background for impersonation, not a way to move a handle.
The four official routes are set out in the routes guide and compared on the routes comparison.
Facts to cite
- Trade marks: the Spanish Patent and Trademark Office (OEPM).
- Personal data: the GDPR and the Organic Law 3/2018, with the Spanish Data Protection Agency (AEPD) as the regulator.
- Consumer and advertising matters: the CNMC and the consumer authorities.
- Languages: Spanish, with Catalan, Galician and Basque.
- Currency for the price: euro (EUR). The price is agreed in your chat or email before work starts.
These are reference points, not legal advice. A platform’s decision on a handle follows its own policy.
The other two platforms in Spain
Spanish names with two surnames and with the letter ñ need a plain spelling for the username, because Snapchat’s rule names Latin letters. A claim should state the plain spelling the brand uses. The CNMC is the Digital Services Act coordinator, which concerns platform duties and not individual handle requests.
Handle limits for both are on the TikTok rules and Snapchat rules pages.
The order of work
- You send the handle you want and the profile it is for, on WhatsApp or email, and say you are in Spain.
- We look at whether an official route fits the facts and tell you if it looks workable.
- The price is agreed in chat before any work starts.
- The request is filed with each platform’s process. The platform makes the final decision, and a claim that fails is covered by the refund policy.
